LAHORE . July 23, 2022 . A 3 -member bench of the Supreme Court of Pakistan (SCP) headed by chief justice , Atta Bandial , announced a short order after hearing the petition filed against the ruling of the deputy speaker , Dost Mohammad Mizari, and ordered that Hamza Shahbaz , who was declared winner of July 22,2022 election, will be acting as trusty chief minister and can not use full scale powers as chief minister Punjab.
The court ordered that Hamza Shahbaz will manage day-to -day affairs of the province till next Monday when the bench will assemble again to hear the case in Islamabad .
Pakistan Tehreek e Insaf (PTI) and Pakistan Muslim League Quaid- e Azam (PMLQ) had challenged the decision of the deputy speaker , Dost Mohammad Mizari, to reject 10 votes of PMLQ after recieving a letter from the party chief . Chaudhary Shujaat Hussain .
Chaudhary Shujaat Hussain as chief of PMLQ written a letter to deputy speaker , Dost Mohammad Mizari, on the day of election saying if his party members vote for joint candidate of PMLQ and PTI they should be counted as per verdict of the SCP.
Deputy speaker , Dost Mohammed Mizari, read the letter written to him by Chaudhary Shujaat Hussain after counting votes of both candidates and then quoted the decision of the SCP and then rejected 10 votes of PMLQ and PTI candidate.
Rejection of 10 votes turned Chaudhary Perez Elahi’s majority into minority and finally Hamza Shahzad was declared as successful .
Hamza Shahbaz had taken oath of the chief minister early on Saturday.
Meanwhile, SCP bench started hearing of the petition which challenge election of Hamza Shahbaz as chief minister.
Chief justice , Umar Atta Bandial , observed during Saturday’s hearing that apparently the deputy speaker’s ruling seems in contrast to the constitution but since it is a complex matter , the court will hear all the stakeholders before giving a final verdict in the case.
Advocate Irfan Qadir who is consel.for Pakistan Muslim League Nawaz PMLN told the SCP bench that the deputy speaker made the apex court’s decision of May 25, 2022 a base for his ruling to reject the votes of PMLQ.
The bench will hear the case on Monday and will try to conclude it on the same day.
