SC seeks minutes of March 29 NA session

Will hear all parties to case. court says

ISLAMABAD : The Supreme Court (SC) on Tuesday sought minutes of the national assembly session held on March 29, 2022.
Chief justice, Umar Atta Bandial , directed to Naeem Bukhari, counsel for speaker national assembly, Asad Qaisar, to present minutes of the national assembly session held on March 29 in the court on Wednesday. The national assembly had held debate on no confidence tabled by joint opposition against prime minister , Imran khan.
The national assembly was supposed to have voting on no confidence on Sunday April 3, 2022. On April 3, deputy speaker, Wasim Suri , instead permitting voting on no confidence rejected the motion citing it as a conspiracy hatched against prime minister, Imran Khan .
SC had taken suo Moto to avert constitutional crisis.
On Tuesday, the Pakistan People Part (PPP) leader and former leader of the Senate argued on the merit of the case. He submitted to the court that deputy speaker can not reject the no confidence motion hence Wasim Suri’s ruling given on April 3, 2022 was illegal. He further submitted that the court should reverse the deputy speaker’s ruling. The court also heard the arguments of Makhdoim Ali Khan , counsel of PMLN on Tuesday. Later, the court adjourned the hearing till April 6, 2022.

Hearing on Monday
The nation awaits a peaceful and workable way forward from the on-going constitutional crisis in the country, the Supreme Court of Pakistan (SCP) deferred the hearing in its suo moto notice case taken to ascertain if the deputy speaker, Qasim Souri,’s ruling terming the opposition’s no confidence motion as an international conspiracy and rejecting it either falls under Article 69 of the constitution till April 5, 2022.
The apex court will resume hearing in the case on Tuesday at 12.05 PM.
The court on Monday raised a number of legal issues involving the case in hand and rejected the plea of the Pakistan People Party (PPP) counsel , Farooq H Naek , to form a full court to hear the case. Chief justice , Umar Atta Bandial, inquired from the PPP counsel if he or his client has no trust in judges hearing the matter. The chief justice remarked that if any client or counsel has any objection or distrust on the bench it can seize to hear the case. Arguing on the merit of the case, Farooq H Naek pleaded before the court that he has full confidence in all the judges of the apex court .He maintained that since in matter in hand was the most important and of great significance he requested for formulation of a full court.The chief justice remarked that formation of a full court to hear this case can delay hearing of other cases .
Farooq H Naek , who is representing PPP in the case had submitted a request for formation of a full bench to hear the suo moto notice on Sunday.
The apex court had taken notice of dissolution of the national assembly and the situation arising put of the speaker’s ruling and taken suo moto notice to avoid any unruly situation in the country. A 5- member bence of the apex court is hearing the case. The bench on Sunday had turned down a request of the PPP counsel to set aside the ruling given by the deputy speaker regarding no confidence motion . The court on Sunday put an important question as if the act of the deputy speaker falls under Article 69 of the constitution . The court on Sunday turned down a request of the PPP counsel to decide the matter on Monday . The chief justice while rejecting the request of Farooq H Naek on the matter on Monday noted that the court can not pass on its decision without hearing to the counsels of all the parties .
Justice Ejazul Ehsan remarked that since the decision in the case would have far reaching impact, the court would not take the decision in haste. He further noted that the court will hear all the parties before giving judgement in the case.
