Faisalabad drug court puts innocents in jail in substandard drug case

PPMA appeals to CJP for reversal of decision ,release of innocents ,Ex PPMA chief , Ansar Farooq calls decision mockery of justice. Noor Mahar deplores drug court decision

ISLAMABAD : Oct 6 : In a flawed decision , a drug court in Faisalabad of judge Syed Javed Bukhari , member Dr Tauseef Iqbal and technical member Ilyas Anwar Shakir, has awarded 4-year jail term with Rs 50000 fine to each of the current managing director Mohammad Wasih Shah, Production Incharge Mohammad Aslam Saqib and Incharge Quality Control , Khalid Qayyum Mughal of Gulf Pharma Rawat for selling substandard medicine to Health Department of Bhukhar.

The Faisalabad drug court announced its decision in devoid of the merit and basic principle of justice and slapped severe punishment to three innocents.

The drug court awarded jail term and fine to the current managing director , Mohammad Wasih Shah and two employees of Gulf Pharm who have nothing to do with Gulf Pharma and the case in question when the case in question was registered in 2016 . At the time of the crime Munawar Khan was the owner of Gulf Pharma .

A verification teport of the Drug Regulatory Authority of Pakistan (DRAP) of the ministry of Health Services and Regulations dated October 30, 2017 had confirmed that Munawar Khan was the owner /managing director of Gulf Pharma Rawat when the case was registered way back in 22016.

Surprisingly , the drug court of Faisalabad overlooked the verification report of DRAP and instead summoning to the real culprits awarded severe punishment and heavy fine to Mohammad Wasih Shah, the current managing director of Gulf Pharma.

The initial report of the case has indicated that in ,2016 Gulf Pharma Rawat had sold out its Diartin 50 mg tablet to Bhakhar Health Department which was later declared substandard. The drug court instead summoning to Munawar Khan , the managing director of Gulf Pharma Rawat when its medicine was declared substandard, jailed current innocent managing director of the company. The report which the court made a base to award jail terms and fine to innocent owner and two of his senior employees itself confirms that the declo phenix sodium had ,100 % quantity, but its dissolution in water took more time. The drug court ‘s decision in Gulf Pharma Rawat case has shocked the pharma industry of Pakistan. Commenting on the Faisalabad Drug Court decision ,

Chaudhary Ansar Farooq , former president of Pakistan Pharma Manufacturers Association (PPMA), said the drug court of Faisalabad ‘s decision to put the new managing director of Gulf Pharma Rawat , Mohammad Wasih Shah and two other innocent employees in jail for 4 years is a mockery of justice . He said the drug court instead punishing the owner at the time of the crime –Munawar Khan– for has awarded jail term of 4 -year with fine to new managing director of Gulf Pharma Rawat , Mohammad Wasih Shah. Chaudhary Ansar Farooq said ” How innocents can be punished for a crime committed by any third person”.

He appealed to the chief justice of Pakistan , Faez Isa , to take notice of the flawed decision of Faisalabad drug court and order release of all innocents including managing director of Gulf Pharma Rawat, Mohammad Wasih Shah.

Noor Mahar , president pharmacists association of Pakistan, also deplored the drug court decision. He said the decision of Faisalabad drug court was against the real spirit of law.
