ISLAMABAD : Feb 23,2023: A larger bench of the Supreme Court of Pakistan (SCP) on Thursday got divided over taking suo moto notice on delay in announcing schedule of general election in the. Punjab and Khyber Pukhtunkhaw (KPK) .
Justice Jamal Mandukhel who is a member of the larger bench constituted by the chief justice of Pakistan (CJP) , Umar Atta Bandial , to hear the case observed during the hearing into the case that the apex court’s decision to take suo moto notice in the case on the recommendations of two judges of the court who are also part of the bench is making the nature of the case doubtful. He also observed that the inclusion of those two judges whose audio taps have leaked and their credibility was in question is not an healthy sign for Pakistan’s judicial system.
Justice Arhar Minallah also questioned the formation of the bench and observed that the court should look into the reason which were made a base for dissolution of two provincial assemblies . He also observed that the people elect their representatives for five years and the parliamentarians are supposed to play their role for five years. The judge noted that the court will also see as if the chief ministers had solid reasons to dissolve the assemblies or they dissolve the assemblies on the pressure of someone.
Chief justice , Umar Atta Bandial observed during the hearing that in the case of dissolution of the assemblies the new elections are required to be held in 90 days. He observed that the court will not tolerate violation of the constitution in any case.
The court will resume hearing in the case at 11AM.
Meanwhile, the Pakistan Muslim League Nawaz (PMLN) senior vice president , Maryam Nawaz, lashed out at the senior judiciary of Pakistan .
In her address to a public gathering in Sargodha today , Maryam Nawaz laveled serious allegations on two judges of the SCP who are part of the bench hearing the case .She said “Two judges of SCP has taken responsibility to bring Imran Khan into power”.
Interior minister , Rana Sanaullah, also came hard on top judiciary of Pakistan. He told the public rally in Sargodha that in the presence of some judges who credibility is in question he does not expects justice from SCP.
