ISLAMABAD: Feb 7,2023: A session court of Islamabad on Tuesday granted one- time exemption to Pakistan Tehreek e Insaf (PTI) chief , Imran Khan, from personal appearance in Tosha Khana reference case here.
Earlier , the judge had fixed February 7 for indictment of PTI chief in Tosha Khana case.
A team of lawyers composing Ali Zafar, Ali Bukhari and Gohar Ali Khan , appeared in the session court for defence of PTI chief.
The counsels for PTI chief had sought exemption for their client from appearing before the court in Tosha Khana case on medical ground .
The judge accepted the PTI plea that delayed indictment of PTI chairman for now.
On the outset of the hearing Ali Bukhari advocate , pleaded before the court that since his client Imran Khan, is injured in Wazirabad firing case , he may be exempted from personal appearance till his doctors allow him to travel and appear before the court.
On this judge inquired from Ali Bukhari and other legal aides of Imran Khan that if their client keeps on requesting for exemption in the case how come the court would indict him in the Toshakhana case .
During the hearing , the counsels for PTI chief and Election Commission of Pakistan (ECP) had heated debate . The counsel for Imran Khan reacted to Saad Hasan advocate , the counsel for ECP, over his biting comments on PTI chief.
Opposing to the counsels for Imran Khan, the counsel for ECP said ” He (Imran Khan) keeps on dancing on the container, but he remains absent from the court to avoid indictment in the case in question.
Hearing harsh words of the counsel for ECP, Al Bukhari , said the counsel for ECP rather than exposing himself as ‘Munshi’should argue on the merits of the case and avoid to pass on the comments like dancing about PTI chief.
On another occasion , the counsels for PTI chief objected to the comments made by the counsel for ECP wherein he claimed that Imran Khan brings ”Mirasi’ clowns with him when he appears before the court in any case.
The counsels for PTI chief strongly protested over harsh comments of the counsels for ECP and demanded that the counsel for ECP should take his inciting remarks like ‘Mirasi” back.
The counsels for PTI chief informed the court that they were not provided with certified copy of the case by the ECP.
The court ordered to the counsel for ECP to provide certified copy of the judgement in the case to the counsels for Imran Khan.
The judge inquired from the counsels for Imran Khan when their client will ensure his presence before the court to hearing indictment in the case.
The counsels for Imran Khan assured the court that Imran Khan can appear before the court in next hearing after February 15 if his doctors allow him to travel .
