PESHAWAR: The Peshawar High Court (PHC) has dismissed Senior Civil Judge Lower Dir, Justice Jamshaid Kundi from serve on proving his misconduct.
The PHC order dated March 4, 2022 noted that disciplinary proceedings against Mr Mohammad Jashaid Kundi , Senior Civil Judge, under Khyber Pukhtunkhaw government servants (Efficiency & Discipline ) Rules 2011. The accused officer was served with charge sheet and statement of allegations. Meanwhile an inquiry officer conducted the inquiry as per the rules and submitted his report. Thereafter the accused/ officer was served with final show cause notice and receiving the reply , the accused/ officer was opted for personal hearing . Accordingly, he was personally heard on February 14, 2022.
The court order maintained that after going through the findings and recommendations of the inquiry officer, material on record , reply to the final show cause notice and subsequent personal hearing. The accused officer is found guilty of misconduct.
It added that the competent authority awards the accused officer major penalty and dismiss from service under the rules.
Senior Civil Judge Lower Dir, Jamshaid Kundi, was accused of sexually assaulting a women at his official residence. The accused judge, according to the allegations leveled against him by the victim, had extorted Rs 1.5 million in the form of jewelary as she had no cash to provide to the accused judge for providing service to her sister. The accused judge after some time informed the victim that he is unable to arrange job for her sister and invited the victim to his official residence for reclaiming her ornaments. When the victim reached at the accused official residence, he demanded sexual offer from the lady for returning her golden jewelary which she rejected. However the accused had rape with her by force and also did not return her gold.
The victim after the incident approached to the Lower Dir Police which had medical examination of the victim which proved the rape. On confirmation of the rape allegation, the Lower Dir Police immediately arrested to the accused judge and sent him to the lockup.
