LAHORE: Jan 14, 2023: After 48 hours from signing the advice by chief minister , Chaudhary Pervez Elahi, Punjab assembly stood dissolved today (Saturday) even though Governor , Balighur Rehman declined to notify the summary.
The chief minister had signed the advice for dissolution of the Punjab assembly 48 hours ago and sent the summary to the Governor for notification .
On receipt of the summary, the Governor held threadbare discussion with his legal team and later consulted the issue with Pakistan Muslim League Nawaz (PMLN) top leadership including prime minister Shahbaz Sharif and Fiance minister , Ishaq Dar , and in the light of these discussions he denied to notify dissolution of the Punjab assembly.
The Governor in his tweet on Saturday evening said ” I will not be a part of the process of dissolution of the Punjab assembly and hense would not notify its dissolution.
In legal and constitutional terms , the Governor ‘s decline had no impact as the Punjab assembly stood dissolved even without his endorsement after 48;hours.
As per the constitution , after dissolution of the Punjab assembly the process of having care taker setup in the province will commence forthwith. The leader of the house (Chief minister ) and leader of the opposition in Punjab assembly will give their panels comprising three names for care taker chief minister . As per the constitution , the leader of the house and opposition leader have 7 days to reach to a consensus on the name for the caretaker chief minister. In case the leader of the house and opposition leader fail to reach to a consensus on the care taker chief minister name, the matter will ultimate go to the Election Commission and it will pick a name of its choice for the caretaker chief minister . The Election Commission’s nomination for the slot will be final.
Since Chaudhary Pervez Elahi and Hamza Sharif , the leader of the house and opposition leader respectively, do not have talking terms , there is very little chance that they will reach to a consensus name to have a care taker chief minister in Punjab. In such a case , there is a possibility that the matter will be finally decided by the chief justice.
