SC declares deputy speaker’s ruling unconstitutional

5 -member bench gave historic decision

ISLAMABAD : The Supreme Court of Pakistan (SCP) has declared the deputy speaker’s ruling of April 3, unconstitutional and restored the government of Imran Khan and his cabinet . The court also declared all orders of the president , Dr Arif Alvi , and prime minister , Imran Khan . after April 3, ultra constitutional. The apex court ordered the speaker to convene the session of the national assembly not later than April 9 by 10.30 AM. The court also ordered to the speaker not to stop any member from voting on no confidence motion .
The apex court heard the case on day to day basis. The bench heard to all the parties before giving final judgement on Thursday.
Earlier, Attorney general of Pakistan , Khalid Javed Khan, on Thursday refused to defend the ruling of deputy speaker , Qasim Suri wherein he under Article 5 of the constitution , had rejected no confidence motion against prime minister, Imran Khan, on April 3,2022.
The deputy speaker misused his position and referred Article 69 of the constitution to take cover of the action which was sheer abrogation of the constitution . The entire purpose of the deputy speaker of rejecting the no confidence was to block removal of prime minister , Imran Khan . The action of the deputy speaker of April 3, 2022
had thrown Pakistan into a serious constitutional crisis.
The Attorney general submitted before the Supreme Court of Pakistan (SCP) bench hearing the case of ruling given by the deputy speaker on April 3, 2022 that he was not in.a position to defend the ruling issued by him for rejection of no confidence motion as he does not want to waste the time of the apex court in this crucial case when he can but defend this case. The Attorney general denial of defending the deputy speaker brought the status of Imran Khan and his legal aides as well as policy think tank to zero. Naeem Bukhari , counsel of the speaker , argued before the bench that the court can review the action of the deputy speaker of April 3, 2022. He said the court was authorised to review the action of the speaker if it is not in line with the constitution . Chief justice , Umar Atta Bandial , observed that the court understands the ruling of the deputy speaker was against the law and in violation of the constitution . Now the court , he added, was considering its related developments. The chief justice referred Sri Lanka’s case and showed concern about economic situation of Pakistan .
The chief justice noted” We are hearing that dollar verses rupee has gone up to Rs 190 and its an alarming situation,’.
Justice Jamal Mandokhal told the counsel of the speaker that the court will take decision in this case as per the law and the possible outcome does not make any difference for it.
The court was informed by Pakistan Muslim League Nawaz (PMLN) that going back to the parliament can be the first step toward stopping economic meltdown.
