SHC takes notice of road blockade

Karachi::The Sindh High Court (SHC) on Tuesday ordered to issue notices to SP Traffic East Karachi and others on a contempt application filed by Pasban Democratic Party (PDP) against closure of roads near the National Stadium Karachi in connection with the ongoing PSL matches.
PDP through its lawyer Khalid Siddiqui Advocate filed an application under section 3 and 4 of contempt of court Act and Article 199-A of the constitution of Pakistan against Farah Umbreen SP Traffic East Karachi and Ali Asghar Mehar,focal person home department, governemtn of Sindh.

The petitioner submitted that this Honourable Court may be pleased to punish the Contemnors, above named, as the alleged Contemnors in flagrant violation and disobedience of the Order dated 17.02.2021, passed by this Hon’ble Court in the above petition, as the above said Contemnors have clearly violated their own undertaking which was made part of this Hon’ble Court’s Order, whereby the alleged Contemnors have categorically stated that neither these roads are blocked at the moment nor it will be blocked during the PSL, however they submitted that at the time of arrival and departure of players they are making some security arrangements for limited period of time but they have given clear assurance and undertaking that the above roads shall not be blocked during the PSL.
The roads mentioned are from Central Prison to NIPA and Sir Shah Suleman Road heading towards Dalmia (Aga Khan Hospital Road).

The above mentioned roads from Central Prison to NIPA and Sir Shah Suleman Road heading from New Town to Dalmia (Aga Khan Hospital Road) has been again blocked by the Contemnors by putting Containers and hurdles on it and police personnel standing on the roads are also restraining the vehicles and public from movement, the petitioner further submitted.

They said that the alleged contemnors have therefore, exposed them-selves to be proceeded against by this Hon’ble Court under the law of contempt for violating and disobeying the orders of this Hon’ble Court, prosecuted and punished under the Contempt of Court Act/Law.

“It is therefore, respectfully prayed that that this Hon’ble court may be pleased to initiate contempt proceedings against the alleged contemnors and they be punished accordingly and Dalmia (Aga Khan Hospital Road) may be opened forthwith.”

A division bench comprising Justice Muhammad Ali Mazhar and Justice Amjad Saheto ordered to issue notices to alleged contemnors and adjourned the hearing till February 26, 2021, Friday.
