SCP orders release of Imran Khan terming his arrest in Al-Qadir Trust case illegal

Written order of 3-member bench in case says "Today's decision does no affect NAB's investigations against former PM".

ISLAMABAD : May 11, 2023:A three-member bench of the Supreme Court if Pakistan (SCP) has released its verdict in Imran Khan’s arrest case. The decision noted that PTI chairman’s arrest from Islamabad High Court (IHC) was not only illegal, but also sheer violation of the basic human rights enshrined in the constitution of Pakistan.

Top court’s judgement added that ita decision of Thursday will not affect NAB investigation against Imran Khan in Al-Qadir Trust case.

The decision also directed Imran Khan to appear before IHC on Friday (today) .

Imran Khan as per SCP decision will stay at a guest house in police protection and appear before IHC to surrender in the case in question.

Earlier , 3-member bench led by Chief Justice of Pakistan (CJP), Umar Atta Bandial , had ordered immediate release of Imran Khan citing his arrest aw illegal and against the constitutionally granted basic rights.

There is a new twist in the on –going political and judicial fronts, the Supreme Court of Pakistan (SCP) has directed to the National Accountability Bureau (NAB) to produce Pakistan Tehreek e Insaf (PTI) chairman , Imran Khan, before it in just one hour.

A 3-member bench headed by SCP, Umar Atta Bandial, gave the order to produce Imran Khan before the court at 4.30 PM today during hearing the plea filed by PTI against the arrest of Imran Khan in Al-Qadir Trust case .
The court said it will see if the former prime minister’s arrest in Al-Qadir Trust case was legal and under what authority around 80 Rangers had entered into the Islamabad High Court (IHC) to arrest Imran Khan.
Three -member bench is hearing a plea filed by the PTI against arrest of Imran Khan from the premises of IHC in Al-Qadir Trust case.

Chief justice , Umar Atta Bandial , observed that entry of dozens of Rangers in IHC premises for arrest of Imran Khan was contempt of the court. CJP observed that the court will take a final decision on the plea today.
Justice Athar Minallah who is also one of the member of the bench hearing the plea against arrest of Imran Khan observed that the procedure followed for arrest of the PTI chairman can not be endorsed. He also observed that NAB passed on the responsibility of the action taken to arrest Imran Khan from the premises of the court.
On the outset of the hearing into the case , Imran Khan’s counsel, Hamid Khan , informed the court that his client went to IHC for seeking bail in the case and during the process of biometric , around 100 Rangers entered into the premises of IHC to arrest Imran khan. He argued that Imran Khan’s arrest from the premises of IHC was a major question for independence of the judiciary.

Salman Raja , another counsel for Imran Khan, pleaded before the court that NAB overstepped for illegal arrest of PTI chairman and the SCP should grant relief to his client.
