Members can n’t be barred from voting: SC rules

Voting on no confidence motion

ISLAMABAD : The government on Monday assured the Supreme Court of Pakistan (SCP) that it will guraunttee conducive environment on the day of voting on no confidence motion and none of the member of the national assembly be bared from casting his vote which is the constitutional right of the elected representatives on the no confidence motion.
Attorney general of Pakistan , Khalid Javed , also assured the apex court during the hearing of a petition filed by the Supreme Court Bar Association (SCBA) that there would be no public gathering at D- Chowk to make sure that the members of the national assembly cast vote on no confidence motion without any fear and restriction .
A bench headed by Chief Justice of Pakistan (CJP) is hearing a petition seeking the court verdict on the announcements made by reg government and opposition to hold public rally outside the parliament at D-Chowk on the day of voting on.no confidence.
The chief justice observed during the hearing that since the constitution gives the right to every member of the parliament to express his will and vote on any issue presented in the parliament therefore any such restriction will be illegal and unconstitutional . The court further observed that both the government and opposition should show restraints to avoid any clash between their supporters . The chief justice of Pakistan observed that the court will like to make sure that the workers of the political workers stay away from D-Chowk on the day of voting . The chief justice of Pakistan suggested to the parties to the case (govt and opposition) that they should sit together and find out a peaceful and amicable solution to the issue presented before the court .
Attorney general assured the court thar the government would make all measures for security and safety of the parliamentarians so that they could use their eight to vote on n the day of voting on no confidence .
The attorney general pleaded before the court that the act of a few ruling party members national assembly and workers of attacking the Sindh House a few day ago can not be defended . He condemned the act and informed the court that he has already talked to the prime minister on the issue . The court after hearing the arguements of the attorney general and the counsel of the opposition directed to the both parties to submit their written guarantee that they will not hold public gatherings at D<- Chowk and voting on no confidence will be held in free and conducive atmosphere .
