The Islamabad High Court (IHC) has disposed off the writ petition filed by the Centre for Rule of Law (CRL) for the implementation of free and compulsory education. The Court has directed the Federal Government and the Education Advisory Council to enforce and implement the Right to Free and Compulsory Education Act, 2012, and to ensure that free and compulsory education is provided to children.
During the proceedings, the Court directed the Federal Government to constitute the Education Advisory Council under Section 22 of the Right to Free and Compulsory Education Act, 2012. It also directed the Government to submit a report on the condition of schools and the facilities available to children to ensure that their educational needs are met and their rights under the Act are realized. In its directions, the Court also emphasised that no child should remain uneducated and that every child must be able to take all the benefits of education related facilities.
The writ petition was filed by Mr. Muhammad Majid Bashir, Advocate, President of the Centre for Rule of Law.
It had sought the enforcement of the comprehensive legislation passed by Parliament in 2012. Under the Act, the government must make the necessary arrangements to provide free and compulsory education to all children between the ages five to sixteen years. The Act applies to the Islamabad Capital Territory, it requires that education be free of costs, and it entitles every child to this right without discrimination
