ISLAMBAD : October ,24,2022:. In a petition filed before Islamabad High Court (IHC) , the Pakistan Tehreek -e- Insaf (PTI) has got partial , but much- needed relief in Imran Khan disqualification case.
IHC Chief justice , Athar MinAllah , while observing on the PTI petition noted that ECP ‘s decision of disqualifying Imran Khan was restricted to only notified seat of the national assembly and it does not restrict him from contesting from any constituency of the national assembly.
The judge also observed that PTI can contest upcoming election of Khurrum agency also.
however, the judge remained unconvinced with the arguments of Imran Khan’s counsel , Ali Zafar , who pleaded time and again to issue an order to suspend the Election Commission of Pakistan. (ECP) orders for disqualification of PTI chief Imran Khan in Toshakhana reference case.
The judge inquired from Imran Khan”s counsel as to why his client was in so rush to get suspended ECP’s decision of disqualification in Toshakhana reference case.
ECP had disqualified Imran Khan in Toshakhana reference case last week.
PTI has been resisting the decision and using different tactics for relief .
Ali Zafar rrpestedly tried to convince to the court that ECP decision in Toshakhana reference case was creating problems for PTI and hence he requests for suspension of the ECP decision .
Ali Zafar also argued before the court that he apprehends that ECP can change decision in Imran Khan’s disqualification case . The court rejected these apprehensions and advised to Ali Zafar not to show distust on ECP.
The court told to the counsel of Imran Khan that he should wait for a certified copy for stressing his case before the court and then it will see the case . The judge further observed that there was no precedent of suspending any decision of an authority without a certified copy of the judgment.
