ISLAMABAD : August 12, 2022. An Islamabad district and session court on Friday rejected a request of the police to grant it another 12- day physical remand of Shahbaz Gill to further investigate him and recover his missing cell phone and arrest other accused associated with him in the offence.
Kohsar police presented the Pakistan Tehreek e Insaf (PTI) leader before the judicial magistrate, Umar Shabbir, on completion of time granted by the court for investigation from the accused.
On the outset of the hearing, the investigation officer (IO) informed the court that the accused has made confessions relating to his statement aired by ARY NEWS, but he was not giving information about this associates and about his cell phone he used for carrying out the offence in a programme of the private TV channel. The IO further added in his arguments that Shahbaz Gill was not cooperating in investigation and he was trying to lie most of the time during investigation.
The IO pleaded that physical remand of the accused for 12 days was important to carry out investigation and get information about his facilitator in the offence .
The legal team of Shahbaz Gill comprising Faisal Chaudhary advocate, Syed Ali Bukhari and Niazullah Niazi advocate strongly opposed extension in physical remand of Shahbaz Gill. They argued that the police has completed investigations during the last 72 hours and further extension in physical remand would be just to physical tortuue to their client .
Shahbaz Gill spoke to the media outside the court room he said the police was torturing him to get a statement against PTI chairman . He also denied in response to a question if he has made any confession regarding his offence during the custody of the police. He alleged that the police was torturing him and keeping him up all the night.
The judicial magistrate after hearing arguments of the both parties rejected the police request for grant of more physical remand of the accused .and sent him to jail on judicial remand.
Review on Shahbaz Gill’s physical remand
The police submitted review in the court of addition session judge Islamabad, Adnan Khan.
The judge after hearing the argument of the prosecutor general Islamabad upheld the decision of the district and session judge and ruled that since the investigation in the case under hearing has completed and the accused has confessed that he made statement to ARY NEWS on 9th of Moharrum through landline phone there was not logic for extension in physical remand of the accused for recovery of his cell phone which apparently was not used for the offence,
Wife of Shahbaz Gill’s driver gets bail
In a separate case, Saira– wife of Shahbaz Gill’s driver who is at large and wanted to the police in the case—was granted bail.
Saira was arrested from her house on August 11, 2022 for assaulting the police during raid conducted for arrest of her husband.
According to the police, Saira and six others attacked the police party when it reached at her house to arrest her husband who is wanted to the police in Shahbaz Gill case .
