ISLAMABAD : October 1, 2022: A court of Islamabad has issued arrest warrant of Pakistan Tehereek e Insaf (PTI) , chairman Imran Khan in harassment to a female judge case.
Rana Mujahid Rahim, senior civil judge Islamabad, issued the arrest warrant of PTI chairman under sections 504, 506, 188 and 189 of The Pakistan Penal Code (PPC).
PTI chief has been booked in the case for using threatening language against a female district and session judge of Islamabad in his address to a public rally held in the federal capital on August 20, 2022.
The police had booked Imran Khan in the case and included section 7 of the Anti Terrorism Act (ATA) . The section relating to terrorism was later dropped from the case when the Islamabad High Court (IHC) enquired from the prosecutor as under which circumstances ATA section was included in the case .
A bench of the IHC taken strong exception to the police for adding terror related sections under ATA against the PTI chairman and sought its explanation during one of the hearings of the case last month, noting how a statement of a person given in a public rally falls under ATA for registering a case of terror.
Seeing concern of the IHC, the police had dropped the section of terrorism against Imran Khan, however, other sections had remained intact.
The senior civil judge Islamabad issued arrest warrant of PTI chairman in the case on September 30 last under four sections which also included section 506 of the Pakistan Penal Code (PPC) which is non bail-able.
Hussnain Kazmi a senior lawyer of the Supreme Court , giving legal opinion on inclusion of section 506 of the PPC said “ The arrest warrant of Imran Khan are non-bail-able due to inclusion of section 506 of PPC”. He added that other three sections included in the arrest warrant of Imran Khan son of Ikramullah were bail-able. The warrant said “ Arrest Imran Khan and present him before the court “.
