IHC suspends order to decide PTI foreign funding case in 30 days

ISLAMABAD : The Islamabad High Court (IHC) on Monday suspended the decision of its single bench wherein it had directed to the Election Commission of Pakistan (ECP) to conclude proceedings and take a final decision in Pakistan Tehreek e Insaf (PTI) foreign funding case in 30 days.
The IHC divisional bench comprising chief justice Athar Minallah and Justice Babar Sattar suspended the single bench order. The single bench of IHC comprising Justice, Mohsin Akhtar Kayani, had passed on the order to ECP to decide the PTI foreign funding case in 30 days.
The PTI had filed an inter court appeal with IHC against the single bench decision . Shah Khawar advocate, counsel for PTI argued before the divisional bench that the honourable judge who passed on the judgment in PTI foreign funding case had used harsh language and hence went beyond his legal limit in passing order to directing ECP in the case. Shah Khawar said the honourable judge used the word “Face the music” in his order which falls beyond legal limits of a judge .
The division bench after hearing the arguments of PTI’s counsel suspended the single bench order in the case and issued notices to the parties to the matter . The court will hearing the attached matter raised by the PTI of directing ECP to club the foreign funding cases of all political parties and hear them on the single case basis for May 17, 2022.
The PTI is demanding of ECP to hear the cases of all political parties in one go and take a decision in uni some .Monday’s decision of IHC is a great relief for PTI. PTI was under huge pressure due to suspended order of IHC and apprehended some damaging decision from ECP in the case .
