ISLAMABAD: The legal fratenity of the country has unwaiverd legal opinion that Hadabiya Paper Mills case has been decided by the Supreme Court of Pakistan once for all and its review too has been exhausted hence it can not be reopend in any case.
Justice (R) Shaiq Usman spoke to a private news channel on Tuesday on the controversy of Hadabiya Paper Mills case.
He was of firm opinion that legally Hadabiya Paper Mills case is over as it has been decided by the apex court of Pakistan and its review also has exhausted so its reopening on any one’s desire is out of question.
Justice (R) Shaiq Usmani is a big name in Pakistan’s legal fraternity and his opinion is considered very important and solid.
Rashid Rizvi is another important name in Pakistan’s legal fraternity. He too has the same legal opinion on the case in discussion. He told a private news channel in a public show that those who are claiming of reopening of the Hadabiya Paper Mills case are misguiding to both the political leadership of the country and its people.
Bilal Raza Advocate is a senior lawyer and has good command on legal issues. He spoke to NEWSMAN by phone on Tuesday to give his legal opinion in the case. He said “I am of firm opinion that legally you can not reopen a case already decided by SCP and the same is true in the case of Hadabiya Paper Mills case, but having said this it is necessary that the authorities should re establish a new case against any person or group of persons whenever any solid chain of crimes (evidence) appears in a case no matter how long it takes during investigation”.
Bilal Raza advocate suggested that instead gropping for an already decided case, the government can file a new reference in Hadabiya Paper Mills case against its accused on the basis of new evidence.
These are very credible legal oppinions of very senior lawyers and on their basis one can understand that either federal cabinet and legal team is giving wrong opinion to the prime minister or he ( Imran Khan) himself wants to waste the public money and time by doing a futile exercise of reopening of already decided Hadabiya Paper Mills case.
Prime minister, Imran Khan, himself has keen interest in creating hope to the masses against impossibilities. He did this many times during his around three years regime. For example, he announced a big oil and gas discovery in the deep sea soon after coming into power when he had no knowledge of it. This created big hope of a change of good days among Pakistanies, but later it turned into a dry hole. This poor nation is yet to understand who adviced Imran Khan to announce huge discovery in deep sea without any solid data that later turned a dry hole and a case of disappointment for the people.
The same is happening in the case of Hadabiya Paper Mills case. It seems a group in the federal cabinet is intentionally misguiding the prime minister on the issue for its own purpose. Better sanity should prevail in the matter before taking any decision in the case to avoid wastage of time and money of the public.
